http://yoursite.com/images/silver/dark/top.jpg - same for other themes - you can edit the *top.jpg* into anything you like. You can also make a *.png image (lossless quality) and then save it as top.jpg - will work (ffox, IE7).

thing is when i edit the top.jpg file or replace/rename it with my own the original top.jpg keeps re-appearing. Any Ideas.
 
I just ended up adding my image as a larger image in settings logo ..but not ideal.

original logo might keep appearing in case you replaced the top logo in a different theme (style) of shop - mine is as in the path above, yours might well be different, I know if works, because it works for me.
Another reason is - refresh your browser, maybe it has the other (older) version cached.
